Welcome to Takeover Technologies Inc. (“Takeover”, “we”, or “us”)!  Takeover is committed to protecting the personal information that we collect, analyze, and share in the use of our personalized fitness and wellness experience, which provide customers with access to various coaches, workout programs, nutrition plans, and a fitness community collectively called (the “Services”) in accordance with all applicable regulatory requirements. This Privacy Policy (the “Policy”) is meant to help you (“Member” or Coach, as applicable) understand how we collect, use and share personal information to operate, improve, develop, protect our Services, and as otherwise outlined in this Policy.

Takeover is responsible under applicable privacy legislation for the personal information in our possession or control. Please refer to the last page of this Policy on how to contact us for further inquiries on how we collect, use, and share personal information. 

 

Personal Information

Privacy legislation in Canada defines “personal information” broadly as any information about an identifiable individual. For Members, this may also include information about your fitness level, nutrition plans, goals, habits, health, coach preferences, and spending preferences, if you have communicated these to us. Your personal information allows us to optimize your personalized fitness plan and help you meet your fitness goals. 

 

Our Purposes For Collecting, Using Or Disclosing Personal Information

 

General

In order to provide Coaches and Members with the Service, Takeover may collect, use and share the following personal information: 

 

Account Registration Information 

During the registration process, Takeover may collect personal information such as first and last name, email, phone number, gender, date of birth, dietary preferences, exercise habits, fitness goals, and Coach & Member preferences in order to find optimal matches for Coaches and Members.

 

For Coaches, Takeover will request additional personal information such as a profile picture, biography, certification, and education in order to assist Members in Coach selection. 

 

Transaction Information 

Takeover may also collect personal information associated to your Service purchase including payment card and billing information. Coaches and Members’ Service are processed by third-party payment processors and Takeover may receive payment information related to your purchase to the Service from these payment processors. 

 

Coaches & Member Interaction and Service Usage

Takeover may collect information about your interaction with and use of our Service such as communication between Coaches and Members within the Takeover platform including text, images, voice recordings and videos. We may also collect information you choose to provide to your Coach related to health and wellness such as exercise information such as available exercise equipment, resting time, repetition & set counts, and any additional information that you provide to us. 

 

Communications   

Takeover may collect personal information such as email, mobile number, mailing address when you request information about our Service, sending a customer or technical support request, subscribe product & promotional newsletters or any other communication with us. If you choose to provide product feedback or Coaches reviews, Takeover may collect the information you choose to share. We may also send email communications to you to advise of feature updates to the Takeover platform, distribute publications or to advise of events. Each email includes an opt-out feature and instructions on how to un-subscribe if you do not wish to receive future e-mails from Takeover for these purposes.

 

Social Media 

If Coaches or Members choose to interact with Takeover via social media sites or link their social accounts with Takeover platform, the social media sites may share personal information with Takeover. Should Members or Coaches choose to limit personal information shared between social media sites and Takeover, you can review your privacy settings on such social media sites and see if you can limit your information sharing practice.    

 

Sites Cookies

Cookies are small elements of data placed on your devices when you visit a website in order to track use of the site and to improve your user experience. Takeover may, from time to time, collect personal information about you and your use of the the Takeover platform though the use of cookies as outlined above. Some browsers can be set to reject all cookies; if you choose to modify your browser in this manner, not all features offered through the Takeover platform may remain available.

Takeover platform may include links to other websites. You should be aware that operators of linked websites may also collect your personal information and information generated through the use of cookies when you link to their websites. Takeover is not responsible for how such third parties collect, use or disclose your personal information, so it is important to review their privacy policies before providing them with your personal information.

 

Third Party Disclosure 

Takeover works with trustworthy third-party companies to act on our behalf to fulfill certain functions in order to offer optimal Service to Coaches and Members. Takeover may use these third-party service providers to assist and handle personal information on our behalf such as analytics, data processing, marketing, etc. 

 

Some of Takeover’s service providers may be located outside of Canada, therefore personal information in these jurisdictions may be accessible to regulatory authorities in accordance with the law. 

 

Except as stated in this policy or as required or permitted by law, Takeover will not disclose any of your personal information to any other organization or disclose personal information to third-party organizations without obtaining your consent first. 

 

However, Takeover may disclose information in the following cases:

• Enforcement or application our Term of Service

• Protection the rights & properties of Takeover 

• Compliance with court orders, subpoena, and warrant by police, investigative body or government institution in accordance with the law 

• Disclosure as it relates to corporate transaction that involves the transfer of all or parts of Takeover, bankruptcy, or acquisition 

 

Google and Web Analytics 

Takeover may use third-party web analytics services on website such as Google Analytics to collect information regarding website visitors and demographics. These providers help us analyze how visitors use our website and Service in order to improve our customer relationship, marketing, Service, marketing and website. Personal information such as aggregated data or de-identified information may be share with current or potential strategic partners as Takeover assess business opportunities.

Personal information is extremely important to Takeover. We have security controls in place in order to protect Coaches and Members against unauthorized access, alteration, duplication, disclosure, destruction or usage. Takeover places appropriate protection to the nature and sensitivity of the personal information. 

 

Each employee at Takeover is responsible for maintaining the confidentiality and security of all personal information to which they have access. 

 

To the fullest extent permitted by applicable legislation and law, Takeover does not accept liability for unauthorized disclosure from any compromised, lost or stolen accounts. By accepting our Terms of Service, you agree that Takeover may contact you electronically regarding administrative, privacy, and security issues related to your usage of our Service. If Takeover learns of a security breach, we may attempt to notify you electronically by posting a notice on our Service and via email. 

 

Information Retention 

Takeover will only retain your personal information to necessarily fulfill the purpose of which it was as collected or as required by law. Personal information will be anonymized or destroyed in the event you no longer use our Service

Takeover strives to maintain accuracy and completeness of Members and Coaches’ information. We may ask you to update your personal information, contact information or preferences from time to time. Any request for us to delete or correct information within your file, must make a request in writing to support@takeovertech.io.

Challenging Compliance With This Privacy Policy

Takeover will respond to complaints from individuals or questions about our compliance with this policy and with applicable privacy laws. We will investigate and attempt to resolve all complaints within a reasonable time.
